Terms of Service & User Agreement

These Terms of Service (the "Terms" or "Agreement") constitute a legally binding electronic agreement under the Information Technology Act, 2000, The Digital Personal Data Protection Act, 2023 (Act No. 22 of 2023), and the Indian Contract Act, 1872 between DheePath Technologies Inc. (academic origin: G.H. Raisoni College of Engineering and Management [GHRCEM], Jalgaon, Maharashtra, India) and any individual or entity accessing or using the DheePath Platform, APIs, radar systems, or verification ledgers (the "Services").

Statutory Duties under DPDP Act 2023: In accessing the platform as a Data Principal, you are statutorily bound by Section 15 of the DPDP Act 2023 to provide true and authentic data, refrain from impersonation, not suppress material information, and avoid registering frivolous complaints or submitting falsified credentials.

By clicking "Create Account", "Start Free Assessment", "Log In", or by otherwise accessing the Services, you confirm that:

• Capacity to Contract: You are at least 16 years of age (or have explicit legal parental/guardian consent if between 16 and 18) and possess full legal capacity to enter into a binding contract.
• Academic Legitimacy: If registering as a student, you are enrolled in or recent alumni of an educational institution (e.g., BCA, B.Tech, B.Sc, MCA, Polytechnic, or equivalent degree programs).
• Corporate Authority: If registering as a Recruiter or Enterprise Partner, you possess verified authority to represent your organization, hold a corporate domain email address, and accept billing and recruitment liability on behalf of your entity.

DheePath enforces strict Role-Based Access Control (RBAC) across distinct user tiers to maintain operational integrity, data privacy, and institutional trust:

Account Security: You are solely responsible for safeguarding your authentication credentials, session tokens, and passwords. You agree not to disclose your password to any third party or allow multiple individuals to share a single account. The value of a DheePath Verified Skill Certificate depends entirely on its rigorous, untampered validity. Any attempt to circumvent platform evaluation mechanisms is treated as academic fraud and a material breach of this Agreement.

3.1 Prohibited Fraudulent Conduct

• Bot Automation & Script Injection: Using headless browsers (Puppeteer, Selenium), script-injected DOM manipulation, auto-clickers, or automated HTTP replay scripts to answer assessment questions or artificially complete weekly roadmap tasks.
• Video Chamber Scrub Bypasses: Tampering with YouTube player iframe postMessage events, fast-forwarding through anti-scrub learning modules, or injecting false playback completion timestamps. Learning sessions require verifiable watch duration before milestone testing unlocks.
• GitHub Telemetry Falsification: Submitting fake Git commit histories, creating artificial commits using backdated scripts, claiming unauthorized third-party repositories, or submitting empty boilerplate repositories to inflate the GitHub AST telemetry score.
• Impersonation & Collusion: Having an unauthorized third party take weekly milestone examinations, sharing active question pools, or running multi-monitor remote screen-share exploits during proctored tests.
• Statutory Infractions under DPDP Act 2023 Section 15: Fabricating credentials, injecting automated quiz scripts, or submitting backdated synthetic Git commits violates statutory duties under Section 15 of the DPDP Act 2023 as well as Section 43 and Section 66 of the Information Technology Act 2000, resulting in instant badge revocation and referral to university disciplinary authorities.

3.2 The 3-Strike Proctoring Protocol

During Weekly Milestone Examinations, DheePath activates real-time client and server proctoring telemetry:

Penalties for Breach: Violation of this Section 3 results in immediate, non-negotiable sanctions: permanent revocation of all earned certificates, deletion of verified radar rankings, locking of the career roadmap, and public invalidation on the SHA-256 verification ledger.

Unlike black-box commercial platforms, DheePath operates on 100% deterministic, transparent mathematical models. Your career readiness scores and recommendation rankings are never decided by unexplainable neural network guesses.

Zero AI Hallucination in Scoring: Large Language Models (LLMs) including Groq LPU (Llama 3.3) and Google Gemini are utilized strictly for natural language explanation generation, weekly curriculum task syntheses, and interview prep dialogue. They have zero authority to arbitrarily adjust, inflate, or penalize your mathematical readiness score.

DheePath is an educational guidance technology platform, career diagnostic roadmap provider, and two-factor skill-verification infrastructure. It is NOT a recruitment agency, employment consultancy, or job broker.

Market salary trends, hiring demand indicators, and salary percentiles displayed across the platform reflect public aggregate industry data and prototype benchmark models. They do not constitute binding salary guarantees for any applicant or student.

DheePath was conceived and engineered at an academic institution (GHRCEM Jalgaon) with an unwavering respect for student creator rights:

• 100% Student Ownership: You retain absolute, unencumbered intellectual property rights, copyright, and patent ownership of all source code, software projects, architectural documentation, repositories, and portfolios linked to or evaluated on DheePath.
• Zero Claim to Repository Rights: DheePath claims no ownership, license, or right of exploitation over your GitHub code. We do not use student code for commercial LLM model training.
• Limited Evaluation License: By connecting your public GitHub profile or submitting a resume, you grant DheePath only a non-exclusive, royalty-free, limited temporary license to parse, compile syntax metrics, and render evaluation summaries solely for your benefit and for your opted-in recruiter profile.
• Platform Intellectual Property: DheePath owns all proprietary software, UI designs, brand assets, logos, 60/25/15 scoring algorithms, verification badge designs, and database schemas associated with the platform. You may not reverse-engineer, decompile, or copy our platform codebase.

To preserve database performance, eliminate fraud, and enforce authentic career commitment, DheePath enforces architectural invariants:

• 7-Day Route Abandonment Cooldown: When a student selects a career track and generates an active roadmap, switching or abandoning the target career is rate-limited by a 7-day programmatic cooldown. This prevents superficial route churn and preserves authentic telemetry.
• Single Active Resume Invariant: Students may maintain only one active resume document on the platform. Uploading a revised PDF automatically and transactionally purges the previous file and its Cloudinary assets.
• API Rate-Limiting: High-frequency requests, automated scraping, or concurrent hammering of assessment endpoints or AI chat channels trigger HTTP 429 (Too Many Requests) throttles. Continued abuse results in IP-range firewall blocking.

DheePath provides students and power users with the option to connect personal API credentials (e.g. OpenAI, Groq, or Google Gemini API keys) for custom roadmap synthesis and unlimited interview practice:

• Zero Backend Transmission: User-supplied BYOK API keys remain strictly quarantined in client-side browser localStorage. They are transmitted directly from your browser to the respective model provider API endpoint and are NEVER logged, saved, or routed through DheePath backend servers.
• User API Cost Responsibility: You are solely responsible for any billing, token costs, or rate-limit consumption incurred on your personal third-party AI provider accounts.
• Instant Revocation: You can purge your stored API keys at any moment with one click via platform settings, which immediately zeroes the corresponding localStorage entry.

Termination by User: You may close your DheePath account at any time through your Profile Settings or by submitting a written request to parthpatil@disheera.site. Upon verified account closure, your profile is immediately de-indexed from the Recruiter Radar and all personal records are purged within 72 hours under our DPDP Act 2023 compliance pipeline.

Suspension by DheePath: We reserve the right to suspend, disable, or terminate access immediately without prior notice if you violate academic integrity rules, attempt SQL/NoSQL injection, abuse recruiter messaging, harass candidates, or create fraudulent corporate recruiter accounts.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE INDIAN LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL DheePath Technologies Inc., GHRCEM JALGAON, ITS FOUNDERS, OFFICERS, DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR CAREER OPPORTUNITIES ARISING FROM OR CONNECTED WITH YOUR USE OF THE SERVICES. IN ALL CASES, OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO DHEEPATH IN THE THREE (3) MONTHS PRECEDING THE CLAIM (OR INR 1,000, WHICHEVER IS LOWER, FOR FREE STUDENT ACCOUNTS).

This Agreement, its interpretation, and any disputes or claims arising out of or related to your use of the Services shall be governed exclusively by and construed in accordance with the laws of the Republic of India, including the Information Technology Act 2000, IT Rules 2021, and the Indian Contract Act 1872, without regard to conflict of law principles.

Mandatory Informal Negotiation: Prior to filing any formal legal action or proceeding, the parties agree to make a good-faith effort to resolve the dispute informally by issuing a written notice of dispute to parthpatil@disheera.site. The parties agree to allow thirty (30) business days for amicable resolution before initiating court proceedings.
